Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Short Term Rentals Florida (the “Platform,” “we,” “us,” or “our”), an online listing service that lets property owners and managers (“Hosts”) advertise medium-term rental properties (stays of 1 to 6 months) and lets prospective renters (“Renters”) discover and contact those Hosts. By accessing the Platform, creating an account, or publishing a listing, you agree to these Terms. If you do not agree, do not use the Platform.

1. We are a listings venue only

The Platform is solely a venue that allows Hosts to advertise properties and Renters to contact Hosts. We are not a real estate broker, agent, property manager, landlord, or party to any rental, lease, or other agreement between Hosts and Renters. We do not own, operate, manage, inspect, endorse, or control any listed property, and we do not take part in the negotiation, execution, or performance of any transaction between users. Any agreement a Renter enters into is directly and exclusively between the Renter and the Host.

2. Host responsibility for legal compliance

Hosts are solely and exclusively responsible for determining whether, and ensuring that, their listing and rental activity comply with all applicable laws. This includes, without limitation, federal, state, county, and municipal laws and ordinances; zoning and land-use rules; short-term and vacation-rental registration, licensing, and permitting requirements; occupancy, health, and safety codes; tax obligations (including any tourist development, sales, or transient rental taxes); homeowners’ association, condominium, and cooperative rules; insurance requirements; and the terms of any lease, mortgage, or other agreement affecting the property.

We do not verify, review, monitor, or make any determination about whether any listing is legal or permitted in its location. The presence of a listing on the Platform is not, and must not be relied upon as, confirmation that the rental is lawful, registered, licensed, or otherwise compliant. We do not provide legal, tax, or regulatory advice. You are responsible for obtaining your own professional advice.

3. Host representations and warranties

By publishing a listing, you represent and warrant that:

• You own the property or are fully authorized to list and rent it for the dates and terms advertised;
• You have obtained all registrations, licenses, permits, and approvals required to lawfully offer the rental in its jurisdiction;
• Your listing, property, and rental activity comply with all applicable laws, regulations, agreements, and association rules;
• All information in your listing is accurate, current, and not misleading; and
• You will collect and remit any applicable taxes and maintain any insurance required by law or agreement.

4. Renter acknowledgement

Renters are responsible for evaluating the suitability, legality, safety, and condition of any property and Host before entering into any agreement or making any payment. We do not screen, background-check, or verify Hosts, Renters, or listings. You interact with other users at your own risk.

5. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 years old and able to form a binding contract. We may suspend or terminate accounts at our discretion.

6. Listing fees

Publishing a listing requires payment of a flat listing fee as shown at checkout. Fees are non-refundable, including if a listing is later removed for any reason, including a violation of these Terms or of applicable law. We may change our fees at any time.

7. Prohibited conduct

You agree not to:

• Post any listing that is unlawful, that you are not authorized to offer, or that lacks any required license, permit, or registration;
• Post false, misleading, fraudulent, or infringing content;
• Violate any law, ordinance, association rule, lease, or third-party right;
• Discriminate against any person in violation of fair-housing or other laws;
• Use the Platform to harass, spam, or harm others; or
• Interfere with or attempt to circumvent the security or operation of the Platform.

8. Content you submit

You retain ownership of the content you submit (listings, photos, messages). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and promoting the Platform. You are responsible for having all rights necessary to grant this license, including rights to any photos you upload.

9. Removal of content

We may, but are not obligated to, review, refuse, edit, or remove any listing or content at any time, with or without notice, including listings we believe may be unlawful or non-compliant. We have no obligation to monitor listings for legal compliance, and any removal does not constitute a determination about legality.

10. Disclaimer of warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT LISTINGS ARE ACCURATE, LAWFUL, LICENSED, OR AVAILABLE. WE MAKE NO WARRANTY REGARDING ANY HOST, GUEST, PROPERTY, OR TRANSACTION.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, ANY LISTING, ANY TRANSACTION OR DISPUTE BETWEEN USERS, OR ANY ALLEGED ILLEGALITY OF A RENTAL. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Platform and its owners, operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: your listings or content; your use of the Platform; your rental activity; any agreement or dispute between you and another user; your violation of these Terms; or your violation of any law, regulation, agreement, or third-party right, including any short-term-rental, zoning, licensing, tax, or fair-housing law.

13. Disputes between users

We are not responsible for the conduct of any user or for any dispute between Hosts and Renters. You release us from any claims, demands, and damages arising out of or connected with any such dispute or with any property or transaction.

14. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute with us will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Your continued use of the Platform after changes take effect constitutes acceptance.
